END-USER LICENSE AGREEMENT FOR Digital Basel

IMPORTANT – READ CAREFULLY: This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Digital Basel regarding your use of the Digital Basel web platform. By accessing or using the Digital Basel platform, you agree to be bound by the terms and conditions of this EULA. If you do not agree to the terms of this EULA, do not use the Digital Basel platform.

DEFINITIONS

"Digital Basel" refers to the online platform operated by Digital Basel. "User" refers to any individual or entity that uses the Digital Basel platform. "Gallery" refers to any art gallery or art dealer who wishes to list their gallery on the Digital Basel platform.

LICENSE GRANT

Subject to the terms and conditions of this EULA, Digital Basel grants you a non-exclusive, non-transferable, limited license to access and use the Digital Basel platform for personal or commercial purposes.

To list your gallery on the Digital Basel platform, you have to use an application form by filling there in details such as gallery name, year established, location, website, contact person, phone, email, and any other relevant information required by Digital Basel. Upon successful application, Digital Basel will create a gallery listing for your gallery on the Digital Basel platform. You will be able to edit and update your gallery information at any time using your Digital Basel account.

The license granted under this EULA does not include any right to, and you shall not, copy, modify, distribute, sell, or transfer any part of the Digital Basel platform, except as expressly provided in this EULA.

TERMINATION

This EULA will terminate automatically if you fail to comply with any of the terms and conditions of this EULA.

Upon termination of this EULA, you must immediately cease all use of the Digital Basel platform and delete any copies of the Digital Basel platform that you have in your possession.

DISCLAIMER OF WARRANTIES

The Digital Basel platform is provided "as is" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose.

Digital Basel does not warrant that the Digital Basel platform will meet your requirements or that the operation of the Digital Basel platform will be uninterrupted or error-free.

Digital Basel is not affiliated with Art Basel in any form or partnership.

All galleries, artworks and prices presented on the website are for advisory purposes only. All information about the galleries, artists, and their artwork has been collected from public sources on the Internet. The images of art are not for sale or commercial use. All information is for informational purposes only, and all rights of owners are respected and protected.

LIMITATION OF LIABILITY

In no event shall Digital Basel be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the Digital Basel platform, even if Digital Basel has been advised of the possibility of such damages.

You agree to indemnify and hold harmless Digital Basel from and against any claims, losses, damages, liabilities, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the Digital Basel platform.
